الخدمات التي نقدمها -

في حالة دفعك رسوم مقدما، و في حالة قمنا باستضافة موقع أو اكثر من مواقعك على سيرفراتنا، ذلك يعني موافقتك على شروطتنا و سياساتنا الواردة في هذه الصفحة، و على أي اتفاقيات أخرى متعلقة بالخدمات التي نقدمها لك. سوف نقدم لك خدمة الاستضافة وفق مواصفات معينة لكل حزمة تختارها أنت أثناء عملية التسجيل. للتوضيح، ام مصطلح " خدمات" الوارد في هذه الصفحة يعود لخدمات الاستضافة التي نقدمها لك، أما اذا كنت أحد أعضاء برنامج التسويق و العمولات ستكون الخدمة التي نوفرها لك من خلال هذا البرنامج هي فقط تحويل العميل الينا. مصطلح " شركة قمة هوست" أو " نحن" أو "لنا" يعود فقط لشركة قمة هوست لخدمات الانترنت و التسويق الالكتروني.

ترخيص استضافة ملفاتك -

لتستطيع استضافة موقعك، من الضروري أن تقوم برفع محتويات موقعك الى سيرفراتنا. عندما تقوم بعملية الرفع، فأنت تقوم بعمل اكثر من نسخة من محتويات موقعك على سيرفرتنا. عند قيامك بشراء خدمات الاستضافة لدينا تكون على علم مسبق بعمل مثل هذه النسخ، و اعطائنا الإذن (ترخيص) لتصميم هذه النسخ و جعلها مرئية للزوار على شبكة الإنترنت. انت وحدك المسئول عن تقديم جميع الملفات التي تكون موقعك.

متى سوف تكون الخدمة متوفرة -

سوف نحاول توفير الخدمة متوفرة 24 ساعة يوميا 7 أيام في الأسبوع. و لكن في بعض الأوقات، و لعدد من الأسباب ربما تكون الخدمة غير متوفرة لكم. يجب ان تدرك و تتقهم طبيعة تكنولوجيا الاستضافة، و أن عدد توفر الخدمة المفاجئ لا يمكن تخطيه بتاتا. أحيانا يكون هناك عطل في أجهزة الخادم. و في أوقات دورية نجري صيانة دورية للأجهزة او تطوير البرامج المثبتة عليها لضمان تقديم أفضل خدمة لكم. أيضا قد يكون هناك بعض الأسباب كانقطاع كيبلات الطاقة، انقطاع وسائل الاتصالات أو كيبلات النقل الرقمية، هجوم على شبكات المعلومات، أو التحميل الزائد و هذا نادر جدا، قد تسبب عدم توفر الخدمة مؤقتا.

المعلومات الشخصية -

عند طلب أي خدمة من خدماتنا، ستكون جميع معلوماتك الشخصية متضمنة معلومات بطاقة الإتتمان، محمية و مشفرة باستخدام تكنولوجيا التشفير المعروفة باختصار SSL، هذه التقنية تستخدم لتشفير البيانات الهامة و الحساسة. نحن نأخذ خصوصيتكم على محمل الجد، و لذلك، لن نقوم ببيع معلومتاكم الشخصية لأي طرف آخر (اي شركة أخرى قد تشتري شركة قمة هوست سوف تتولى هي حماية معلوماتكم و الإبقاء عليها سرية من السرقة أو الإشهار لأي طرف آخر) اقرأ المزيد عن سياسية الخصوصية الخاصة بنا من خلال هذا الرابط سياسة الخصوصية

إلغاء الحساب -

و كما نوضح في هذه الفقرة، نحن نعرض عليك ضمان استرجاع أموالك في حال قمت بإلغاء حسابك لدينا. و هنا ستعرف كيف تعمل سياسة إلغاء الحساب. إذا قمت بالغاء حسابك خلال 30 يوما من تاريخ أول يوم تم فيه إنشاء الحساب، سوف نقوم برد كلما المبلغ لكم باستثناء  أي رسوم تركيب و رسوم تسجيل اسم النطاق (الدومين) و هي (15.00$). و الطريقة الوحيدة لإلغاء حسابكم هي بإرسال رسالة متضمنة إلغاء الحساب عبر العنوان التالي:

في حالة قمنا نحن بتسجيل اسم النطاق الخاص بك كجزء من خطة الاستضافة لدينا، و قررت إلغاء حسابك خلال أول 30 يوما، سوف نتقطع ثمن تسجيل اسم النطاق الخاص بكم من المبلغ المسترد. نحن ندفع مقابل تسجيل اسم النطاق (الدومين) مبلغ $15.00 سنويا من ثمن خطة الاستضافة التي تدفعها أنت. لذلك إذا قمت بإلغاء حسابك بعد 30 يوما من تاريخ تسجيل الحساب أو حتى بعد تجديد الحساب للسنة القادمة، للأسف لن تحصل على استرداد أي مبلغ.
الرجاء الانتباه: تطوير خطة الاستضافة، تسجيل النطاق أو تحويله و شراء شهادات التشفير  لا تحتوي على ضمانة استرداد الأموال. أيضا سياساتنا لا تتضمن خدمات تصميم المواقع إذا تم بدأ العمل بالفعل. إذا قمت بطلب خدمة تصميم موقع و قررت إلغاء هذا الطلب قبل البدء في العمل على التصميم قبل مرور 30 يوما سوف تقوم برد كامل المبلغ لكم.

ملاحظة للأسعار الخاصة -

هناك أسعار و رسوم خاصة متوفرة فقط لنظام الدفع الشهري، كل 3 شهور، و النصف سنوي و التي تأتي مع رسوم تركيب 25.00$، هذه الرسوم لايمكن ازالتها أو استردادها في حالة إلغاء الحساب حتى لو كانت خلال اول 30 يوم

التجديد الآلي للحساب -

عند تسجيل حساب، ستقوم قمة هوست بتفعيل التجديد الآلي، و الذي يعني أن معلومات موقعك متضمن خطة الاستضافة و تسجيل اسم النطاق. عند قرب موعد التجديد، سنقوم بأخذ قيمة الخطة تلقائيا اذا كنت قد سجلت لدينا بواسطة بطاقة ائتمانية. إذا أردت عدم تجديد حسابك تلقائيا، يجب عليك أخيار ذلك قبل 14 يوما من تاريخ التجديد. إذا كان لديك أي استفسار بخصوص تاريخ تجديد الحساب، الرجاء الدخول الى حسابك من خلال هذا الرابط:

، أو اتصل بنا. إذا فشلت بإلغاء هذه الخاصية سيتم تجديد حسابك لمدة جديدة.

إذا مر أكثر من 30 يوماً بعد إنشاء اي فاتورة و لم نستلم كامل المبلغ سوف نقوم بتعليق الحساب، و هذا يعني أن بيانات موقعك لن تكون متوفرة على سيرفراتنا ولكن لا يمكن عرضها على موقعك. و في حالة قمت بدفع كامل المبلغ سوف يتم إعادة تفعيل موقعك و سيعمل من جديد. أما إذا مر 30 يوما بدون دفع المبلغ فسيكون من حق شركة قمة هوست حذف الحساب بما فيه من ملفات نهائياً. باختصار، إذا لم نستلم كلمل المبلغ في مدة أقصاها 60 يوماُ، جميع معلوماتك سوف تحذف نهائيا. أنت تقر بأن هذه هي سياسات شركة قمة هوست في حال أمر يتعلق الامر بالاحتفاظ بالبيانات و التنازل عن الحقوق في مثل هذه الحالات.

الاستخدام المقبول / النشاط غير المشروع -

تسعى شركة قمة هوست للحفاظ على مستوى عال من الخدمة ، والكثير من العملاء لدينا يعتمدون على أعلى معايير الجودة التي نقدمها. لذلك نحن لا نقدم خدماتنا للذين يسخدمون خدماتنا للأغراض التالية:

• القرصنة، و التي تتضمن، على سبيل المثال اختراق أو محاولة الوصول، بدون تصريح، حاسوب آخر أو شبكة. بحث عن المنافذ المفتوحة، تسلل، و طرق سرقة بطاقات الإتتمان "الخداع" أيضا ممنوعة.
• استضافة الملفات او البيانات الاخرى ان يتعدى بها على حقوق المؤلف أو حقوق أخرى او غيرها من حقوق الملكيه الفكريه.
• السبام، أو إرسال رسائل بدون علم صاحب البريد الالكتروني بأعداد كبيرة جدا الى عدد كبير من البريد الالكتروني. نحن نمنع استخدام السبام، و التي تتضمن ارسال رسائل تجارية غير مصرح بها باستخدام خدمات قمة هوست، أو استغلال خدمة ارسال الرسائل باستخدام بروتوكول ارسائل البريد الالكتروني المفتوح. نحن نحتفظ بحقنا في رفض أو انهاء الخدمة المقدمة استناداً الى مؤشرات استخدامك للسبام.
• رفع او ربط لأي محتوى من الممكن أن يتنهك حقوق الآخرين أو الخصوصية.
• نشر كلام مسئ، أو أي محتوى آخر يحتوي كلمات بذيئة أو تجرح بأحد أو تشهير بشخص معين.
• استضافة أو تخزين أو توزيع مواد اباحية، سواء كانت للكبار و أو للأطفال. إذا تم ملاحظة أي محتوى من هذا النوع فسوف نتخذ الإجراءات القانونية بهذا الشأن.

التحميل الغير عادي على السيرفر -

While our shared services are suitable for the bulk of our customers, there comes a time for some websites when they are better suited for a larger plan, which allows for more dedicated CPU and memory resources. We reserve the right, in our sole discretion, to discontinue service to any customer with a website or other hosted data that takes up more than 10% of the resources of the server's CPU. This means that if your website is found to be utilizing more than 10% of the CPU and memory of the service, we reserve the right to take your site offline. If this becomes necessary, you can either upgrade your hosting package, or request a pro-rated refund of the amounts you have paid in advance for the services. Due to the severity of this, and our ability to act quickly to correct these situations to avoid server issues, we will do everything reasonably feasible to provide you with a warning prior to taking your site offline, but we accept no obligation to do so.

Due to our evolving business, and the changing nature of the web hosting industry, these terms of service may change. We will post the changes here, and your continued use of the service means you accept the changes we have made.

انتهاك حقوق الطبع و النشر -

In accordance with the Digital Millennium Copyright Act, we have adopted a policy to suspend or terminate the accounts of website owners found to be in violation of copyright. We respect the intellectual property of others, and we ask you to do the same. We may, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who may be repeat infringers. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide our Copyright Agent (identified below) the following information:

• 1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
• 2. a description of the copyrighted work or other intellectual property that you claim has been infringed;
• 3. a description of where the material that you claim is infringing is located on the site;
• 4. your address, telephone number, and email address;
• 5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• 6. a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

If QemaHost, Inc. is sued or threatened with a lawsuit from a third party because of something you do with the services, or as an affiliate you agree to pick up the tab if QemaHost, Inc. is found liable or pays to settle the dispute. In legal terms, this is called "indemnification." Not only do you agree to reimburse QemaHost, Inc. for what it pays to satisfy a judgment or settle a case, you also agree to pay QemaHost, Inc.'s reasonable attorney's fees and all other costs QemaHost, Inc. incurs in defending itself.

EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. QemaHost, Inc. MAKES NO WARRANTY THAT ITS SERVICES WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, OR THAT DEFECTS WILL BE CORRECTED. QemaHost, Inc. DOES NOT WARRANT, NOR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR RESULTS OF, ANY OF THE SERVICES IT PROVIDES, IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. Some jurisdictions do not allow the disclaimer of implied warranties, in which event that foregoing disclaimer may not apply to you.

HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states may not allow such a broad exclusion or limitation on liability for damages as contained in these terms of services. In those states, our liability is limited to the full extent permitted by law. You agree that in no event shall our maximum aggregate liability exceed the total amount paid by you for the services in dispute purchased from us, or, in the event of liability of QemaHost, Inc. due to your enrollment in the affiliate program,

الشروط المطبقة على برنامج العمولات -

برنامج العمولات أو المكافآت الخاص بنا -

To participate as an affiliate, you are required to complete an affiliate application located at QemaHost, Inc.Affiliates.com. The application will be evaluated, and we will notify you in a reasonable time whether your application has been accepted. At our discretion, we may decide for any reason that your site cannot participate in our network. If you are a U.S. resident, we will require that you provide us with your Social Security Number or Tax ID number. We do not require this information for international affiliates.

كيف تعمل -

We provide our affiliates with unique tracking codes. These codes must be placed in the HTML of your website and when clicked on will direct visitors to your site to QemaHost, Inc..com or one of our other websites. If the visitor to your site places an order in the following 365 days from the same computer (cookie tracking) or the same Internet connection (ip tracking), our automated system will track the sale and automatically credit your account.

In order for automated tracking to be successful the visitor must have clicked on your tracking pixel, have cookies and JavaScript enabled in their browser, not clear cookies or switch Internet Service Providers before placing your order. If the automated tracking fails for any reason and you wish to earn commission for this referral you must contact QemaHost, Inc. Affiliate Support at affiliates@QemaHost, Inc..com. When you contact us, please include the domain name, full name, and e-mail address of the customer you referred. The date and time of the order would also be helpful. If you are not able to provide this specific information then unfortunately we may not be able to issue a credit to your account. We will investigate any missed commissions to the best of our ability, however if we are not able to verify the referral we may not be able to issue a credit.

العمولات -

Commissions will be paid to affiliates based on successful referrals. A successful referral, or sale, is defined as: a non-fraudulent, active for a period of thirty (30) days, not cancelled web hosting client who has paid for services in full and has been directed to us through your affiliate tracking link.

Because of the high frequency of credit card fraud and cancellation rates, we reserve the right to hold commissions for up to 60 days for verification. We also reserve the right to cancel commissions in the event that we are unable to collect funds, the order is fraudulent, the customer cancels within the first 30 days, or if we learn that the commission was earned improperly for any other reason.

There are two pay periods during every month. Pay periods are two weeks long. The first pay period is from the 1st of the month until the 15th. The second is from the 16th of the month to the last day of the month. QemaHost, Inc. will process affiliate commissions for the past month period before this on these dates and issue payments. For example: On January 5th you earn $500 via the QemaHost, Inc. Affiliate Programs. The commission becomes mature 30 days after we track it, or in this case on February 5th. The next pay date is February 16th, so on February 16th you would be paid for these referrals. This time frame allows us to evaluate every order and assess its validity. In the event we are unable to verify the order during this time frame, we may, at our sole discretion, hold your commission or cancel the order. Cancelled commissions cannot be reinstated.

قاعدة العمولات -

Commission rates are posted on www.qemahost.com/affiliates.html and will be updated from time to time. If you have received a custom commission from us in exchange for a large number of referrals, then QemaHost, Inc. may modify your account settings to reflect this. We consider custom commissions for any affiliate who is able to send five (5) or more new customers per month. Our various programs are managed by various affiliate managers, which can be found at www.qemahost.com/affiliates.html

شروط الاتفاقية -

The term of this affiliate agreement will begin upon our acceptance of your affiliate program application, and will end when terminated by either involved party. Either party may terminate the affiliate relationship, with or without cause, by giving written notice of termination to the other. Notice of termination must be delivered to us by sending an e-mail to affiliates@qemahost.com Once terminated, you will not be eligible to receive commissions for any future referrals.
